Terms of Service

1. Agreement and operator
These Terms of Service (“Terms”) govern access to and use of the ProvenShot website, iOS and Android applications, public verifier and related services (the “Service”).
The Service is operated by DLANPER TECH SLU, tax identification number B19482017, with registered address at Calle Palencia, 3, 28522 Rivas-Vaciamadrid, Madrid, Spain.
By creating an account, purchasing a plan or using the Service, you agree to these Terms and acknowledge the Privacy Policy. Mandatory consumer rights remain unaffected.
2. What ProvenShot provides
ProvenShot enables users to create verifiable technical records for photos and videos captured directly through the app. A proof may include capture time, location based on available signals, device or security signals, cryptographic fingerprints, integrity information and a verification record.
The original capture remains in the user’s device gallery. The app processes and compresses the capture on-device. ProvenShot stores an encrypted compressed copy and related proof assets in secured cloud infrastructure so that the proof can be maintained, verified and, when selected by the user, displayed through a verification link or QR code.
ProvenShot evidence concerns technical provenance and integrity. It does not by itself establish that a scene is legal, complete, contextualised, authorised by third parties or materially true in every respect, and it does not guarantee acceptance by a court, authority, insurer, platform or other third party.
3. Eligibility
You must be at least 14 years old in Spain, or at least the minimum age required in your country, to use the Service without valid consent or authorisation from a parent or legal guardian.
By using the Service, you confirm that you have legal capacity to enter into these Terms or that the required authorisation has been obtained.
4. Accounts and security
- You must provide accurate information and keep it updated.
- You are responsible for safeguarding your password, device, authentication methods, shared links and QR codes.
- You must not share an account, impersonate another person, access another user’s proof without authorisation or attempt to bypass access controls.
- You must promptly notify ProvenShot of suspected unauthorised use or security incidents.
5. Plans, Proof Packs, subscriptions and payments
ProvenShot may offer a free plan, subscriptions, one-time Proof Packs and other paid functions. Current features, usage limits, total price, taxes where applicable, renewal conditions and payment obligations are shown before purchase.
Web payments are processed by Stripe. Android purchases are processed through Google Play Billing. iOS purchases are processed through Apple In-App Purchase. Platform purchases are also subject to the applicable platform terms.
Subscriptions renew automatically at the end of each billing period unless cancelled before the applicable renewal deadline. Cancellation stops future renewals but does not automatically refund an already-started billing period, except where required by law.
Proof Packs do not expire unless clearly stated otherwise before purchase. ProvenShot may change future prices or plan features with reasonable advance notice. A change does not affect a completed one-time purchase.
6. Consumer withdrawal and refunds
For web purchases, consumers normally have fourteen days from the contract date to exercise the statutory right of withdrawal, subject to applicable exceptions.
Where checkout offers immediate performance, the user may expressly request that ProvenShot begin providing the digital service before the withdrawal period ends. If the user withdraws after performance has begun, ProvenShot may charge the proportion corresponding to the service already provided where permitted by law. The right of withdrawal is lost only where all applicable legal requirements are satisfied, including the required prior express consent, acknowledgement and durable confirmation.
Where no paid Proof or paid service has been used, ProvenShot will assess a withdrawal request in accordance with mandatory consumer law. Where a Proof Pack or subscription has been partly used, any deduction or refund will be calculated in accordance with the service supplied and applicable law.
Refunds for Apple or Google purchases must normally be requested through the relevant platform, without prejudice to mandatory consumer rights.
To exercise withdrawal for a web purchase, contact privacy@provenshot.com and identify the account, purchase and decision to withdraw. ProvenShot may provide a model withdrawal form or equivalent electronic process.
7. User content, ownership and licence
You retain ownership of the content you capture and of the original file held in your device gallery.
You grant ProvenShot a limited, non-exclusive, worldwide licence, for the duration necessary to provide the Service, to receive, store and process an encrypted compressed copy; calculate and store technical fingerprints and proof metadata; generate certified derivatives, thumbnails and QR assets; and decrypt, transmit and display the compressed copy solely to provide certification, verification, download and sharing functions selected by you.
This licence does not permit ProvenShot to sell your content, use it for unrelated advertising, publish it outside the functions selected by you or use it to train artificial-intelligence models.
The licence ends when the corresponding content is deleted, except for limited information lawfully retained for legal obligations, security, an open report or the establishment, exercise or defence of claims.
8. Visibility and voluntary sharing
Creating a proof does not automatically make all proof information public.
Before sharing, you select which proof information is visible, which may include precise location, approximate location, nickname, date and time and cryptographic details. Precise location requires an additional warning and affirmative confirmation.
You may voluntarily share certified media, a verification link or a QR code. Anyone who receives a shared link or QR code may access the information you selected and may forward it.
Shared access is delivered through the authorised verifier and signed, time-limited media URLs. Access may end when the URL expires, the proof is deleted or restricted, or public sharing is withdrawn.
You are responsible for reviewing visibility settings and for the consequences of sharing a link, QR code or certified media.
9. Rights and permissions relating to captured content
You are responsible for ensuring that you have the rights, permissions, consents or another lawful basis required to capture, certify, publish and share content.
A ProvenShot proof does not grant permission to record or publish people, property, documents, trademarks, minors, confidential information or personal data.
You must not use the Service to create a misleading impression that illegal, unauthorised or harmful content is lawful or approved merely because it has a ProvenShot proof.
10. Acceptable use
- Use the Service for illegal, fraudulent, deceptive or abusive purposes.
- Forge, manipulate, tamper with or misrepresent a proof or verification result.
- Attempt to bypass authentication, signed access, encryption, rate limits, security measures or access controls.
- Reverse engineer, scrape, overload, disrupt or introduce malicious code into the Service, except where mandatory law expressly permits limited interoperability activity.
- Harass, stalk, threaten, extort, defame, impersonate or dox another person.
- Publish intimate or sexual content without consent, child sexual abuse material, content exploiting minors, private documents, private addresses or sensitive locations without a lawful basis.
- Infringe privacy, image rights, confidentiality, intellectual property or other third-party rights.
- Resell or commercially exploit the Service without written authorisation.
11. Verification and limitations of the proof
A verification result indicates whether the submitted file matches a certified technical record and may confirm capture time, location according to available signals and integrity status.
ProvenShot does not certify the identity of every person shown, ownership of depicted property, legality of the capture, completeness of the scene, absence of staged or synthetic elements in the physical scene, or the legal admissibility or weight of the proof.
ProvenShot does not guarantee that a third party will accept a proof for a particular purpose.
12. Identified reporting, moderation and preservation
The verifier may provide a reporting mechanism for content that allegedly exposes personal data, minors, private documents, sensitive locations, intimate content, intellectual property or other unlawful or rights-infringing material.
The in-product reporting mechanism requires a signed-in ProvenShot account with a verified email. Reports must be submitted in good faith and contain enough information to identify the proof and explain the concern. Formal identified privacy or legal rights notices may also be sent to privacy@provenshot.com.
ProvenShot may review, limit, hide, suspend, disable or remove a proof, verification page, QR code, link, visible metadata, sharing function or account when reasonably necessary for safety, rights protection, fraud prevention or legal compliance.
Submitting a report does not by itself establish that content is unlawful. A moderation action does not constitute a final legal determination or an admission of liability.
If a sufficiently substantiated report, legal request or claim is open, ProvenShot may restrict deletion and preserve only the evidence reasonably necessary in an access-controlled legal hold. Unrelated data will be deleted or processed normally. The hold will be reviewed and lifted when no longer justified.
Where required by applicable law, ProvenShot will inform the affected account of a restriction or removal, the principal reasons and available review or complaint options.
13. Suspension, account closure and deletion
You may close your account at any time through the available account-deletion process.
ProvenShot may restrict or suspend an account for security, suspected fraud, legal requirements, repeated or serious breach of these Terms, or protection of users and third parties.
When an account is deleted, active proofs, encrypted compressed media, related assets and public verification pages are deleted or scheduled for deletion. Previously shared links and QR codes may stop working.
Limited records may be retained where required by law, accounting rules, an open report, security needs or the establishment, exercise or defence of legal claims. Immutable technical anchors may remain where they cannot technically be erased, but they may no longer correspond to an active public proof.
Deletion may be delayed only to the extent reasonably necessary for a documented and lawful preservation hold.
Account deletion may be initiated from the available in-app process or through https://provenshot.com/account-deletion. If an active subscription is still set to renew (Stripe, Apple or Google), you must cancel it before the deletion can be completed; the deletion process will indicate where to do so. Deleting the ProvenShot account does not itself cancel billing by the platform, so this requirement prevents you from continuing to pay for a service you could no longer access.
14. Intellectual property in the Service
ProvenShot’s software, design, trademarks, databases, documentation and other Service materials, excluding user content, are owned by DLANPER TECH SLU or its licensors. Subject to these Terms, you receive a personal, limited, revocable, non-exclusive and non-transferable licence to use the Service.
15. Third-party services
The Service relies on third-party infrastructure, payment platforms, mapping services, app stores and communication providers. Their own terms and privacy notices may apply to the services they independently provide. ProvenShot is not responsible for a third party’s systems beyond the responsibilities imposed by applicable law.
16. Availability and changes to the Service
ProvenShot may update, improve, replace or discontinue features. Where a change materially affects a paid service, ProvenShot will provide reasonable notice and respect mandatory consumer rights.
The Service may be temporarily unavailable because of maintenance, security events, provider failures or circumstances beyond reasonable control.
17. Disclaimers
The Service is provided on an “as is” and “as available” basis to the extent permitted by law. ProvenShot does not guarantee uninterrupted operation, error-free processing or protection against every possible threat. Nothing in these Terms excludes warranties or remedies that cannot lawfully be excluded.
18. Liability
To the maximum extent permitted by law, ProvenShot is not liable for indirect, incidental, special or consequential losses arising from misuse of the Service, unauthorised sharing by a user, loss of a device copy, reliance on a proof beyond its stated technical scope or third-party rejection of a proof.
Where liability may lawfully be limited, ProvenShot’s aggregate liability for a claim will not exceed the amount paid by the user to ProvenShot during the twelve months before the event giving rise to the claim.
These limitations do not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, breach of mandatory data-protection or consumer law, or any other liability that cannot lawfully be excluded or limited.
19. User responsibility and indemnity
To the extent permitted by law, you are responsible for claims arising from content you unlawfully capture or share, your infringement of third-party rights, your misuse of the Service or your material breach of these Terms. This clause does not reduce mandatory consumer protections or make a consumer liable beyond what the law permits.
20. Changes to these Terms
ProvenShot may update these Terms for legal, security, technical or service reasons. The current version will be published with a new date. Material changes will be notified in advance where required. Changes will not retroactively remove rights already acquired under mandatory law.
21. Governing law and jurisdiction
These Terms are governed by Spanish law. Courts in Madrid, Spain will have jurisdiction except where mandatory consumer or procedural law entitles a user to bring proceedings in another competent court, including the courts of the user’s habitual residence.
22. Language
These Terms are available in English and Spanish. Both versions are intended to have the same meaning. In the event of an inconsistency, the Spanish version will prevail, without prejudice to mandatory consumer rights or interpretations more favourable to the consumer under applicable law.
